Law No. 6698 on “Protection of Personal Data” has entered into force. We would like to inform you about the said legislation and some definitions specified therein:

Personal data: Any kind of information relating to an identified or identifiable natural person,

Processing of personal data: Any operation performed on data, whether wholly or partially automated, or non-automated means of processing personal data, including collection, recording, storage, preservation, alteration, adaptation, disclosure, transfer, takeover, making data available, classification, or prevention of use,

Data processor: A natural or legal person who processes personal data on behalf of the data controller based on the authority given by the data controller,

Data recording system: The record system in which personal data is structured according to certain criteria,

Data controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.

1. Purpose of Protection of Personal Data and Consent Text and Our Company’s Position as Data Controller:

Our shopping website holds the status of “data controller” within the scope of Law No. 6698 on the Protection of Personal Data (“Law”) regarding personal data related to customers, and the purpose of this Personal Data Protection and Consent Text is to inform customers about the personal data processing activities carried out by our shopping website in accordance with the Law and to obtain explicit consent for the situations specified in item 3 below.

2. Personal Data to be Processed in Accordance with the Explicit Consent of Customers and Processing Purposes:

For the situations below, where the conditions for processing personal data stated in Articles 5/2 and 6/3 of the Law cannot be met, explicit consent of the customers is required for the processing of personal data by our shopping website.

3. Purpose of Processing Personal Data of Customers:

Personal data of customers are processed within the framework of the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law. Personal data of customers are processed for the following purposes:

– Carrying out necessary studies by the business units to benefit individuals concerned from the products and services offered by our shopping website and to execute related business processes,
– Carrying out necessary studies by the relevant business units for the realization of commercial activities conducted by our shopping website and the execution of related business processes,
– Planning and execution of commercial and/or business strategies of our shopping website,
– Planning and execution of activities necessary for the provision of legal, technical, and commercial-business security of the individuals in business relationship with our shopping website and for the customization of products and services offered by us according to the preferences, usage habits, and needs of the individuals, and for the promotion and introduction of these products and services to the relevant individuals,
– Establishment and follow-up of visitor records,
– Ensuring compliance with obligations within the scope of Consumer Protection Law, Regulation on Retail Trade Regulation, and other legal regulations through our company and our branches, call centers, affiliated companies, websites, and social media pages, or any channels without limitation, by Company, aiming at ensuring compliance with obligations,
– Providing better service to customers, providing various advantages, sales, marketing, information, providing information about promotions, providing information about campaigns and conditions, conducting surveys, customer satisfaction surveys, speeding up your purchase transactions, receiving and delivering your orders,
– Creating campaigns for customers, conducting cross-selling, determining target audience,
– Carrying out activities to track customer movements, conducting activities to enhance user experience, and improving the functioning of our shopping website and mobile application according to customer needs, executing direct and indirect marketing, personalized marketing, and remarketing activities, conducting activities such as personalized segmentation, targeting, analysis, and internal reporting, conducting market research,
– Planning and executing customer satisfaction activities and customer relationship management processes, including planning and executing sales and marketing processes of products and/or services of our shopping website, establishing and/or increasing loyalty to the products and/or services offered by our shopping website within the framework of the consent given by the Customer as well as the processes of our shopping website, and sharing with the parties specified in this Personal Data Protection Text.

Our shopping website has the right to associate the behavior of the user on the site with a cookie (cookie) in the browser to enable online behavioral advertising and marketing even if the user is not a member of the site and to identify re-marketing lists based on metrics such as the number of pages viewed, the duration of visits, and the completion of targets. Later, targeted advertising content can be displayed to this user on the site or on other sites in the Display Ad Network based on the interests of the users. During the redirection of Google AFS advertisements to our Shopping Website, Google may place cookies in the user’s browser or read cookies in them or use web beacons to collect information.

4. Transfer of Personal Data of Customers:

Personal data of customers may be shared with authorized officials, our affiliates, business partners, suppliers, shareholders, legally authorized public institutions and organizations, and private institutions in accordance with the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law, including carrying out necessary studies by the business units to benefit individuals concerned from the products and services offered by our shopping website and to execute related business processes, carrying out necessary studies by the relevant business units for the realization of commercial activities conducted by our shopping website and the execution of related business processes, planning and execution of commercial and/or business strategies of our shopping website, provision of legal, technical, and commercial-business security of the individuals in business relationship with our shopping website, and customization of products and services offered by our shopping website according to the preferences, usage habits, and needs of the individuals, and promotion and introduction of these products and services to the relevant individuals.

The Name and Contact Information of the User may be shared with payment organizations in order to perform identity verification in accordance with the framework agreement to be approved by the user during the payment stage and the Regulation on Measures Regarding Prevention of Laundering of Crime Revenues and Financing of Terrorism published in the Official Gazette dated January 9, 2008, and numbered 26751.

Our shopping website may transfer personal data to third parties domestically or abroad in accordance with the conditions stipulated in Law No. 6698, provided that the conditions are met.

5. Method of Collecting Personal Data and Legal Reason:

Personal data is collected from customers electronically. Personal data collected for the reasons mentioned above can be processed and transferred in accordance with the purposes specified in Articles 5 and 6 of the Law and in this Personal Data Protection Text.

6. Storage Periods of Personal Data:

Our shopping website stores personal data for the periods specified in the relevant laws and regulations when necessary.

If there is no period specified in the legislation regarding how long personal data should be stored, personal data is processed for a period necessary for the practices and commercial life of our Shopping Website based on the activity carried out while processing that data, then deleted, destroyed, or anonymized.

When the purpose of processing personal data ceases; and if the related legislation and the storage periods determined by our Shopping Website have come to an end; personal data can only be stored for the purpose of being used as evidence in possible legal disputes or for asserting or defending the relevant right related to personal data, or if it is necessary to establish the defense, even if the limitation periods

for asserting the mentioned right and the limitation periods have expired. The storage periods are determined based on examples in previous requests addressed to our Shopping Website regarding the same issues even after the expiration of the mentioned periods. In this case, the stored personal data is not accessed for any other purpose, and access to the relevant personal data is provided only when necessary for use in the relevant legal dispute. After the mentioned period, personal data is deleted, destroyed, or anonymized.

7. Rights of Customers as Personal Data Subjects:

Data subjects have the rights under Article 11 of the Law: (i) to learn whether personal data concerning them is processed, (ii) to request information if personal data has been processed, (iii) to learn the purpose of processing personal data and whether they are used in accordance with the purpose, (iv) to know the third parties to whom personal data is transferred at home or abroad, (v) to request the correction of personal data if it is incomplete or incorrectly processed and to request notification of the transaction made within this scope to the third parties to whom personal data is transferred, (vi) to request the deletion or destruction of personal data in case the reasons requiring their processing disappear, even though they have been processed in accordance with the Law and other relevant laws, and to request notification of the transaction made within this scope to the third parties to whom personal data is transferred, (vii) to object to the emergence of a result against the person by analyzing the processed data exclusively through automated systems, and (viii) to demand the compensation of the damage in case of damage due to the processing of personal data unlawfully.

Requests regarding the exercise of these rights can be communicated to our Shopping Website by the data subjects through the methods specified within the scope of Law No. 6698. Our shopping website will evaluate such requests and conclude them within 30 days.

Changes may occur regarding the matters included in this form in line with legal and technological developments.
